Terms & Conditions of Sale
These general terms and conditions of sale (T&Cs) govern the contractual relationship between Hill's Donuts and any consumer purchasing on hillsdonuts.shop. By placing an order, the customer accepts these T&Cs without reservation.
1. Scope
These T&Cs apply to all orders placed on hillsdonuts.shop by consumers (B2C) residing in Belgium.
2. Products
Our products are freshly baked artisanal donuts. Photographs are illustrative only — slight variations in glazing and toppings may occur. Allergen information is available on the product pages and on our dedicated allergens page.
3. Prices
Prices are shown in euros (€), all taxes included (VAT 6% on food). Shipping costs are clearly displayed before the final order confirmation.
4. Order & contract formation
The contract is formed when we send the order confirmation email to the customer. We reserve the right to refuse any order for legitimate reasons.
5. Payment
Payment is due at the time of ordering by Bancontact, Visa, Mastercard or Apple Pay through our secure payment provider. The order is only processed once payment is confirmed.
6. Delivery
We deliver throughout Belgium via bpost on the date selected by the customer at checkout. Estimated delivery windows are indicative and may vary depending on the carrier.
7. Right of withdrawal — perishable food exception
Pursuant to Article VI.53, 4° of the Belgian Code of Economic Law, the right of withdrawal does NOT apply to our products, as they are foodstuffs that are liable to deteriorate or expire rapidly. As a result, orders cannot be cancelled or returned once they have been confirmed and dispatched.
8. Conformity & complaints
If a product is damaged, missing or non-conforming on arrival, please contact us at hello@hillsdonuts.shop within 24 hours of delivery, including a photograph. We will offer a replacement or refund where appropriate.
9. Liability
Hill's Donuts cannot be held liable for any consequence resulting from the consumer ignoring the allergen information clearly indicated on each product page.
10. Personal data
Personal data collected when placing an order is processed in accordance with our Privacy Policy.
11. Applicable law & jurisdiction
These T&Cs are governed by Belgian law. Any dispute will be brought before the competent courts of Tournai. Consumers may also use the EU Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr/
